- August W. Heckman III The State of New York on April 20, 2024 enacted its budget for fiscal year 2025 (FY 2025). The budget introduces two significant obligations for employers related to paid leave, which will require them to provide employees (1) up to 20 hours of paid leave for prenatal care and (2) paid lactation breaks. Additionally, the budget sets an expiration date of July 31, 2025 for the state’s COVID-19 paid sick leave law, closing out one of New York’s signature legal efforts enacted during the COVID-19 pandemic. 6
- Danny Astin #NonCompetes A major business cultural shift a long time coming. Lots of questions coming into our office from contract counter parties and the C-Suite on the FTC bam of non-competes. While the trend nationally has been for courts to disfavor and limit scope and duration of non-competes— this is a game changer that encourages free movement of workers. Frankly in the digital age with work remote and anywhere culture - it’s no surprise. Historically the band have had the biggest impact on the rank and file. How this will effect existing contracts- that may be another question altogether. With the new rules on overtime the US has moved closer to other developed economies in balancing the inherent power of those who control the means of production and the capital- with the need of the average worker to be fairly compensated, have the least restricted opportunity to maximizevalue for their services in the market place, and have work life balance. The Frances Perkins Workplace Equity Act, recently signed into law, will take effect in 2025. This law requires employers with 25 or more employees in the Commonwealth to disclose pay ranges in job postings, promotions, and transfers. It aims to address gender and racial wage disparities, supporting efforts to close the pay gap and ensure fair compensation for all workers.Key Feature: Pay Data ReportingThe Act also includes a notable pay data reporting requirement. Employers with at least 100 employees must submit detailed demographic and pay data reports. AB 2930 has passed the Assembly and is now before the Senate Appropriations Committee. - Texas Association of Staffing Once again, the U.S. Department of Labor released a final rule increasing the minimum salary thresholds for administrative, executive, and professional exemptions under the Fair Labor Standards Act. As a result, employees who were formerly exempt from minimum wage and overtime requirements (based on the current $684 per week threshold) may need to be reclassified as nonexempt. DOL is adopting a phased approach to the increased thresholds, starting on July 1, but employers should not delay in analyzing the impact of these changes and planning for the future. #texasstaffing #texas #staffing 3

A theme of reasonableness underlies the opinion; competence, for example, does not require GAI expertness, but a ‘reasonable understanding’ of the technology’s capabilities and limitations, which cannot remain ‘static.’ How much ‘independent verification or review’ will depend on the circumstances of the task. When the ABA first discussed adding a technological component to the competence rule, concern was raised as to the cost to the smaller firms or solo practitioners.
